These Terms of Service (“Terms”) govern access to and use of Spelling Test Buddy, including the website, teacher accounts, student activities, and related services (collectively, the “Service”) provided by jsdf, LLC (“Spelling Test Buddy,” “we,” “us,” or “our”).
By creating an account, purchasing a subscription, or using the Service, you agree to these Terms. If you use the Service on behalf of a school, district, company, or other organization, you represent that you are authorized to accept these Terms on its behalf. If you do not agree to these Terms, do not use the Service.
Eligibility and Authority
You must be legally able to enter into these Terms. Teachers and other adults may create accounts and assign activities to students. Students access assigned activities through Classroom Links and Student Codes and do not create Teacher Accounts.
If you use the Service for a school or district, you are responsible for obtaining any approvals required by your employer and for using the Service consistently with applicable school and district policies.
Teacher Accounts and Account Sharing
Each Teacher Account is licensed for use by one named teacher unless your subscription, order form, or written agreement expressly permits multiple users. You may not share or transfer your Teacher Account or allow another person to access it using your credentials, email sign-in link, Google account, or authenticated browser session.
Each teacher must have a separate Teacher Account. Schools and districts that need access for multiple teachers must purchase or obtain a plan covering the applicable number of teachers.
You must take reasonable steps to protect access to your account and promptly notify us at support@spellingtestbuddy.com if you suspect unauthorized access. You are responsible for activity that you authorize through your account. We may require credential verification or suspend access when reasonably necessary to protect the Service, student information, or other users. Repeated or intentional account sharing may result in suspension, termination, or an appropriate subscription adjustment.
Sharing Classroom Links or Student Codes with the students to whom they are assigned is permitted and is not considered Teacher Account sharing.
Subscriptions and Payment
Some features require a paid subscription. Prices, subscription periods, included users or seats, and other plan details are shown when you purchase the Service or in an applicable order form. You agree to pay the charges associated with the plan you select.
Unless otherwise stated at purchase or in a written agreement, subscriptions may be used only during the applicable subscription period and are nontransferable. Any renewal, cancellation, and refund terms presented at purchase are part of these Terms.
Acceptable Use
You may use the Service only for lawful educational and personal purposes consistent with these Terms. You may not:
- Access or use another person’s Teacher Account without authorization.
- Share a Teacher Account except where expressly permitted by a written agreement with us.
- Attempt to bypass plan, seat, access, or usage limits.
- Interfere with, disrupt, probe, scan, or test the security or operation of the Service without our written permission.
- Upload malicious code or use the Service to violate the rights of another person.
- Copy, resell, sublicense, or commercially exploit the Service except as expressly authorized by us.
- Use automated means to access or extract data from the Service except through functionality we provide or with our written permission.
Student Data and Privacy
Our collection, use, and protection of personal information are described in our Privacy Policy and Student Privacy Protection Policy. Teachers, schools, and districts are responsible for providing appropriate notices, obtaining any required permissions, and entering student information only as permitted by applicable law and their own policies.
Your Content
You retain any rights you have in word lists, assignments, student information, and other content you submit to the Service (“Your Content”). You grant us a limited, nonexclusive license to host, process, reproduce, and display Your Content only as reasonably necessary to operate, maintain, secure, and improve the Service and fulfill our legal obligations.
You represent that you have the rights and permissions needed to submit Your Content and allow us to process it as described in these Terms and our privacy policies.
Our Service and Intellectual Property
The Service, including its software, design, branding, educational materials, and other content provided by us, is owned by jsdf, LLC or its licensors and is protected by applicable intellectual property laws. Except for the limited right to use the Service under these Terms, no rights are transferred to you.
Third-Party Services
The Service may interoperate with or link to third-party services, such as Google Sign-In. Your use of a third-party service may be governed by that provider’s own terms and privacy policy. We are not responsible for third-party services that we do not control.
Suspension and Termination
You may stop using the Service at any time. We may suspend or terminate access if we reasonably believe that you have materially or repeatedly violated these Terms, created a security or legal risk, failed to pay applicable fees, or used the Service in a way that could harm students, users, or the Service.
When practical, we will provide notice and an opportunity to resolve the issue before termination. We may act immediately when reasonably necessary to address an urgent security, safety, legal, or operational risk.
Following termination, provisions that by their nature should survive will remain in effect, including provisions concerning ownership, disclaimers, limitations of liability, and disputes. Requests concerning the export or deletion of personal information will be handled under our privacy policies and applicable agreements.
Service Availability and Disclaimer
We work to provide a reliable and useful Service, but we do not guarantee that the Service will always be available, uninterrupted, secure, or error-free. To the fullest extent permitted by law, the Service is provided “as is” and “as available,” without warranties of any kind, whether express, implied, or statutory, including implied warranties of merchantability, fitness for a particular purpose, and noninfringement.
Nothing in these Terms limits rights or warranties that cannot lawfully be excluded.
Limitation of Liability
To the fullest extent permitted by law, jsdf, LLC and its owners, employees, affiliates, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenues, data, or goodwill, arising from or related to the Service or these Terms.
To the fullest extent permitted by law, our total liability arising from or related to the Service or these Terms will not exceed the greater of (a) the amount you paid us for the Service during the 12 months before the event giving rise to the claim or (b) $100.
These limitations do not apply where prohibited by law.
Governing Law
These Terms are governed by the laws of the State of Illinois, without regard to conflict-of-law principles. Any dispute arising from these Terms or the Service will be brought in a court of competent jurisdiction located in Cook County, Illinois, unless applicable law requires otherwise.
Changes to These Terms
We may update these Terms from time to time. We will post updated Terms on this page and update the “Last updated” date. If a change materially affects your rights or obligations, we will provide additional notice as appropriate. Changes will apply prospectively from their stated effective date.
General Terms
These Terms, together with any applicable order form or written agreement and the policies incorporated above, form the agreement between you and us concerning the Service. If an order form or other written agreement signed by us conflicts with these Terms, the signed agreement controls to the extent of the conflict.
If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver of our right to do so later. You may not transfer these Terms or your account without our written consent. We may transfer these Terms as part of a merger, acquisition, reorganization, or sale of assets.
